These terms of use explain the rules for using revodocs and all related services.
They describe which functions we provide, what obligations apply to users, and how we ensure safe and reliable use.

By using our platform, you accept these terms and conditions.
Please read them carefully to understand how revodocs may be used and what rights and responsibilities exist.

Terms of Use

Our terms of use govern the cooperation on revodocs.de and associated subdomains between you as a user and us as a provider.

§1 Provider, User, Scope

(1) Provider of the internet address revodocs.de and related subdomains and services offered (hereinafter referred to as "Service")

(hereinafter referred to as "Provider").

(2) The provider provides its services exclusively on the basis of these terms of use. Any differing terms and conditions of the user shall not apply unless expressly acknowledged by the provider in writing.

(3) The service is available exclusively to schools, educational institutions, and their employees (teachers, administrative staff). Colleagues working at the same school are not considered third parties. For the purposes of this agreement, a "school" is any educational institution that is registered with its own school number.

(4) Any commercial resale or other transfer of the service to third parties is prohibited without the prior consent of the provider.

§2 Services of the provider

(1) The scope of services is defined in the current service description and price list at https://www.revobytes.de/pakete-preise.

(2) The user undertakes to provide truthful information relevant for the calculation of fees (e.g. number of classes or class trains) and to update it immediately in the event of changes.

(3) In the event of false or incomplete information, the provider may, at its discretion, temporarily block or exclude the user.

(4) Free additional services are provided voluntarily. There is no entitlement to their provision. The provider may change or discontinue them at any time.

(5) The provider may use anonymized or aggregated usage data to improve the service and for internal product analysis. Personal data will only be used for advertising purposes with the user's explicit consent.

§3 Conclusion of Contract

(1) By submitting an order via the online form, the user makes a binding offer to conclude a contract.

(2) The contract is concluded as soon as the provider accepts the user's offer, e.g. by express declaration of acceptance or activation of access.

(3) The provider will confirm the conclusion of the contract by e-mail.

§4 Contract duration and termination

(1) The contract shall be concluded for a period of 12 months.

(2) It shall be automatically extended for a further 12 months unless it is not terminated at the latest 30 days before the end of the contract term will be terminated.

(3) The right to extraordinary termination for good cause remains unaffected.

(4) All notices of termination must be in written form (e.g., email). If the provider offers an electronic termination function within the service, this may be used as an alternative.

(5) After termination of the contract, all user data will be deleted – subject to statutory retention obligations – at the latest 30 days after the contract expires irretrievably deleted.

§5 Remuneration and Payments

(1) The price list valid at the time of conclusion of the contract shall apply. https://www.revobytes.de/preise.All prices include statutory VAT, unless otherwise stated.

(2) The fee is payable in advance for the respective contract period.

(3) If the contract is extended, the fee will be due at the beginning of the new period.

(4) Payments shall be made by invoice.

(5) If the user defaults on payment, the provider is entitled to block access to the service and to demand default interest at the statutory rate (§ 288 BGB).

(6) Price changes apply only to future contract periods and will be announced on the website at least 30 days in advance. The provider will also inform the user in a suitable manner, in particular by email to the contact address last provided by the user.

§6 Rights of Use

(1) The provider grants the user a simple, non-transferable and non-sublicensable right to use the service for the duration of the contract term. revodocs one, insofar as this is necessary for the intended use.

(2) Any reproduction, distribution or other use of the software beyond the contractual use is not permitted.

(3) All rights to the software, the content and the technical infrastructure remain with the provider.

§7 Confidentiality and access data

 The user undertakes to treat access data as strictly confidential and to inform the provider immediately if there is suspicion that unauthorized third parties have gained knowledge of it.

§8 Availability and Disruptions

(1) The provider shall provide the service with an average availability of 99.0 % per calendar month.

(2) Maintenance work of up to 6 hours per calendar month is permitted. This may be carried out on weekdays between 22:00 and 6:00 and on Sundays and public holidays between 6:00 and 12:00. Maintenance work will be announced at least 48 hours in advance.

(3) The provider's responsibility is limited to the point of connection to the public internet. No liability is assumed for outages outside the provider's sphere of influence.

(4) The user undertakes to report any disruptions or malfunctions immediately in order to enable timely rectification.

§9 Blocking and Exclusion

In the event of a breach of these terms of use or in the event of payment default, the provider may, at its discretion and taking into account the interests of the user, temporarily suspend or permanently exclude the user.
Before a permanent ban, the user will be given an opportunity to comment, unless there has been a serious violation.

§10 Liability

(1) The provider shall be liable without limitation for intent and gross negligence as well as for injury to life, body or health.

(2) In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable, typical contractual damage.

(3) Any further liability beyond that mentioned in paragraphs (1) and (2), in particular for indirect damages or lost profits, is excluded.

(4) The provider shall not be liable for data loss if the user has not made adequate data backups.

§11 Data Protection

(1) The provisions of the following shall also apply to the use of the service Privacy Policy under https://revodocs.de/datenschutz.

(2) The provider shall process personal data exclusively within the framework of the applicable data protection laws and only to the extent necessary for the performance of the contract.

(3) The user remains the controller within the meaning of the GDPR for the content and data he or she enters. If the user processes personal data of students, teachers or third parties, a                                                         Data Processing Agreement (DPA) to conclude an agreement with the provider in accordance with Article 28 GDPR.

§12 Changes to the Terms and Conditions

(1) The provider may amend these terms of use with effect for the future, insofar as this is necessary to adapt to legal or technical developments.

(2) Changes will be communicated to the user in writing at least six weeks before they come into effect.

(3) If the user does not object in writing within one month, the changes shall be deemed accepted. The provider shall specifically draw attention to the right to object and the consequences of remaining silent.

§13 Final Provisions

(1) The law of the Federal Republic of Germany shall apply.

(2) The place of performance and – to the extent legally permissible – the place of jurisdiction is the registered office of the provider.

(3) Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.               The statutory regulation applies in place of the ineffective provision.
